Productus Solutions LLC, DBA Homegevity – Terms and Conditions
Please read these Terms and Conditions carefully and in their entirety before using homegevity.pro (hereinafter referred to as the “Site”). The Site and its content are owned by Productus Solutions LLC, DBA Homegevity.
PURPOSE
These Terms and Conditions explain the rules, terms, and conditions of using, viewing, browsing, or purchasing any tool, resource, assessment, or service offered by Homegevity or through the Site.
IMPORTANT NOTES
By using the Site in any capacity, you voluntarily agree to these Terms and Conditions. You agree that you have read, understood, and consented to these Terms and Conditions. If you have any questions, please contact us at help@homegevity.pro.
You must be at least 18 years old to use this Site. If you are under 18 or do not agree with these Terms and Conditions, please do not use the Site.
These Terms and Conditions contain an Arbitration Clause and require you to resolve any dispute with us through binding arbitration. By agreeing to these Terms and Conditions you voluntarily waive your right to a jury trial as described in Section 18.
1. Definitions
- “Company,” “We,” “Our,” or “Us” means Productus Solutions LLC, DBA Homegevity and homegevity.pro.
- “Content” means any and all written, visual, video, or audio information contained on the Site, including but not limited to blog posts, articles, checklists, guides, assessment outputs, proposals, marketing templates, social media posts, newsletters, and instructional materials.
- “Assessment Output” means any recommendation, proposal, checklist, or report generated through the Homegevity assessment tool based on photos and form inputs submitted by a contractor, handyman, or user. Assessment Outputs do not constitute building code determinations, permit guidance, ADA compliance certification, FHA accessibility confirmation, site measurement verification, structural evaluation, nursing assessment, or occupational therapy evaluation.
- “Contractor” means any handyman, remodeler, general contractor, or home improvement professional using the Site or its tools. For purposes of these Terms and Conditions, the term Contractor includes handymen, remodelers, general contractors, and all home improvement professionals as defined herein. These terms are used interchangeably throughout.
- “Licensed Materials” means any marketing materials, social media templates, handouts, or proposal templates provided to contractors and handymen through their purchase or subscription for use with their clients.
- “Personal Information” means information that can be used to identify, contact, or locate a person, including name, email address, zip code, payment information, and account credentials.
- “Per-Report Service” means a single-purchase assessment submission and output generation, purchased without a subscription.
- “Site, Services, and Products” means homegevity.pro and all associated tools, assessment outputs, per-report services, downloads, marketing resources, email communications, and services made available by the Company.
- “Subscription” means a recurring paid membership that may be offered in the future to provide ongoing access to Homegevity tools, resources, and assessment capabilities.
- “You” or “Your” means the user, contractor, handyman, customer, or visitor of the Site.
2. Consent
By using the Site and making any purchase, you implicitly and voluntarily agree to these Terms and Conditions, our Privacy Policy, and our Disclaimer. You represent and warrant that you are at least 18 years old. Any use of the Site by anyone under 18 is unauthorized and in violation of these Terms and Conditions.
3. Site Rules
By using the Site you agree not to:
- Abuse or harass any person through or on the Site
- Post or transmit obscene, offensive, defamatory, or abusive content
- Use the Site in any way that violates applicable law
- Submit spam or unsolicited content
- Post copyrighted materials that do not belong to you
- Promote or sell your own or any third-party products or services through the Site without written permission
- Copy, download, share, or transmit our intellectual property in any way that infringes on our rights
- Submit medical diagnoses, medication details, medical record numbers, insurance member IDs, Social Security numbers, dates of birth, or any other protected health information or sensitive identifying health data through the assessment tool
- Misrepresent Assessment Outputs as certified clinical assessments, nursing assessments, occupational therapy evaluations, medical recommendations, building code determinations, or licensed safety evaluations
- Remove, alter, or obscure any Homegevity disclaimer language from generated proposals or Licensed Materials before presenting them to clients
4. Disclaimer
By using the Site you understand that Homegevity provides assessment tools, marketing resources, and educational content for aging-in-place home modification work. Homegevity does not provide medical, clinical, legal, or licensed professional advice. While Homegevity was founded by a Registered Nurse and Certified Aging-in-Place Specialist, use of this platform does not establish a provider-patient relationship or constitute a clinical consultation. Assessment Outputs do not constitute nursing assessments, occupational therapy evaluations, code inspections, ADA compliance determinations, permit guidance, site measurement verification, or structural evaluations. All Assessment Outputs are for general informational and planning purposes only and require independent verification by a qualified contractor or handyman before implementation. 5. Per-Report Purchases and Future Subscriptions
Homegevity currently offers assessment services on a per-report purchase basis. Each per-report purchase provides a single assessment submission and output generation. You will be charged the applicable per-report fee at the time of purchase.
Homegevity may offer subscription-based access in the future. If and when subscriptions are offered, they will be subject to additional terms including auto-renewal provisions, usage limits, and fair use policies that will be communicated at the time of subscription offering. Continued use of the platform following introduction of subscription terms constitutes acceptance of those terms.
6. No Refund Policy
All sales are final. No refunds will be issued for any per-report purchase, subscription, or digital resource once purchased. By completing your purchase you acknowledge that you have reviewed the platform description and understand what you are purchasing. At our sole discretion, Homegevity may offer a revision in cases where a clear submission processing error is documented. This does not constitute an obligation to revise or refund any purchase.
7. Assessment Submission, Human Review, and Output Quality
Assessment Outputs are limited to the specific interior room or area identified in the Contractor’s submission (e.g., a bathroom). Homegevity does not provide whole-home safety evaluations or structural reviews beyond the scope of the provided images.
Contractor Responsibility: Contractors are solely responsible for submitting clear, accurate, and comprehensive photos.
Scope of Review: Recommendations are strictly limited to conditions visible in submitted photos. Homegevity cannot account for concealed conditions, structural constraints, plumbing, electrical issues, or site-specific realities not disclosed in the intake form.
Revision Policy: Homegevity is not obligated to revise Assessment Outputs due to poor submission quality. Goodwill revisions for documented submission errors may be offered at our sole discretion.
Professional Limitations: Assessment Outputs are for advisory purposes and do not constitute building code determinations, ADA certifications, or structural evaluations. Contractors assume full responsibility for independently verifying all recommendations before client presentation or implementation.
8. Funding and Program Information
Any funding, insurance, benefit, rebate, grant, or assistance program information included in Assessment Outputs or elsewhere on the Site is general informational content only. Availability and eligibility change frequently and must be independently verified with the applicable agency or program administrator. Homegevity makes no guarantee of coverage, reimbursement, eligibility, or funding availability for any specific client or project.
9. Contractor and Handyman Conduct
Contractors and handymen using Homegevity agree to use the platform professionally and in accordance with these Terms and Conditions. The following conduct may result in suspension of access without refund:
- Misrepresenting Assessment Outputs as certified clinical assessments, nursing assessments, occupational therapy evaluations, medical recommendations, building code determinations, or licensed safety evaluations
- Removing or altering Homegevity disclaimer language from generated documents
- Submitting medical diagnoses, medication details, medical record numbers, insurance member IDs, Social Security numbers, dates of birth, or any other protected health information through the platform
- Any violation of these Terms and Conditions, our Privacy Policy, or our Disclaimer
We reserve the right to suspend access at our sole discretion. In cases of suspension for cause, no refund will be issued.
10. Intellectual Property Ownership
The Site and its Content are the intellectual property of Productus Solutions LLC, DBA Homegevity, and are protected by United States copyright and trademark laws. Any unauthorized use, reproduction, or distribution of our Content will be legally pursued to the fullest extent permitted by law.
11. Licensed Materials — Contractor and Handyman Use
As a purchaser or subscriber, you are granted a limited, non-exclusive, non-transferable license to use Homegevity Licensed Materials as follows:
You may:
- Add your business name, logo, and contact information to Licensed Materials
- Share Licensed Materials with your clients and prospective clients
- Present Assessment Outputs and proposals to homeowners and their families
You may not:
- Resell, redistribute, or sublicense Homegevity Licensed Materials as your own product or service
- Remove or alter Homegevity disclaimer language from any generated document
- Represent Licensed Materials as independently created by you or your business
- Share Licensed Materials with other contractors, handymen, or third parties for their commercial use
- Use Licensed Materials after your access period has ended
This license is active only while your purchase or subscription remains current and in good standing.
12. Your License to Us
By submitting photos, form responses, comments, or other content through the Site, you represent that you have the legal right to submit such content and grant Productus Solutions LLC, DBA Homegevity a license to use submitted data to generate Assessment Outputs, improve platform quality, and conduct internal research as described in our Privacy Policy.
Homeowner Consent Warranty: You explicitly represent and warrant that you have obtained all necessary consents and permissions from the homeowner or resident before photographing their property and submitting those images to the Site. You assume full legal liability for any privacy claims arising from unauthorized photos submitted through your account.
13. Sharing the Site and Its Content
You must request and receive written permission before sharing any part of our Site or its Content for commercial purposes. You may share the Site for personal or referral purposes provided you link directly to the original source and give full credit to Homegevity. You may not represent our Content as your own or imply any affiliation with Productus Solutions LLC, DBA Homegevity beyond your role as a purchaser or subscriber.
14. No Claims Regarding Results
Any testimonials, contractor profiles, or examples featured on the Site reflect individual experiences only. They are not guarantees of future results. Each contractor’s and handyman’s circumstances, market, and effort are unique and results will vary.
15. No Warranties
The Site, Services, and Products are offered as-is and without warranties of any kind, express or implied, to the extent permitted by law. We do not warrant that Assessment Outputs will prevent falls, injuries, or accidents. Home modification outcomes depend on many factors outside our control including contractor and handyman skill, product quality, individual functional abilities, and home-specific variables.
Service Availability: Homegevity relies on third-party APIs and cloud infrastructure to generate Assessment Outputs. We do not guarantee 100% uptime or uninterrupted access to the Site. We are not liable for delays, data loss, or business interruptions caused by third-party server outages, API downtime, or routine maintenance.
16. Release
By using the Site or purchasing any service or product, you agree to release, discharge, and hold harmless Productus Solutions LLC, DBA Homegevity, its founders, employees, agents, contractors, subcontractors, and affiliates from any and all claims, liabilities, damages, judgments, and costs whether known or unknown arising from your use of the platform or your implementation of any Assessment Output.
17. Errors and Omissions
We make every effort to provide accurate and current information on the Site and through our services. However, we cannot warrant that all information is free from errors or up-to-date at all times. You should independently verify any information you rely on from this Site.
18. Payment and Purchases
When you make a purchase you authorize Productus Solutions LLC, DBA Homegevity to charge your payment method for the applicable amount. You will receive an electronic receipt following your purchase which you should retain for your records.
If your payment method fails or is declined your purchase will not be completed and no Assessment Output will be generated until payment is resolved.
Homegevity does not accept chargebacks in lieu of contacting us directly to resolve disputes. If you have a concern about a charge please contact us at help@homegevity.pro before initiating any chargeback process. Unresolved chargebacks may result in suspension of access and referral to collections.
Payment processing is handled through Stripe. We are not responsible for the policies or practices of Stripe or any other third-party payment processor.
19. Arbitration Clause
If any dispute arises from your use of the Site or Homegevity services, please contact us first at help@homegevity.pro to attempt to resolve the matter directly.
If we are unable to resolve the dispute informally, you agree that all disputes shall be submitted to binding arbitration with the American Arbitration Association before a mutually agreed upon arbitrator in accordance with AAA rules. By agreeing to these Terms and Conditions you waive your right to a jury trial.
Any arbitration hearing shall be held within 120 miles of Chattanooga, Tennessee. The arbitrator’s award shall be binding and may be entered as a judgment in any court of competent jurisdiction in the State of Tennessee. The maximum award available to you is a refund of amounts paid to Productus Solutions LLC, DBA Homegevity for the specific service in dispute. Consequential, punitive, or additional damages are not available.
20. Governing Law
These Terms and Conditions and any dispute arising from them shall be governed by the laws of the State of Tennessee.
21. Consent to Jurisdiction
You irrevocably consent to the exclusive jurisdiction and venue of any federal court in the United States District Court for the District of Tennessee or a state court within the State of Tennessee for any matter arising from these Terms and Conditions or your use of the Site.
22. Consent to Service
You irrevocably agree that process may be served on you in any manner authorized by the laws of the State of Tennessee, and you waive any objection to service of process under those laws.
23. Termination and Suspension
We reserve the right to suspend or terminate your access to the Site and any associated services at our sole discretion if you violate these Terms and Conditions, our Privacy Policy, or our Disclaimer. Termination or suspension for cause will not result in a refund.
24. Limitation of Liability
Productus Solutions LLC, DBA Homegevity is not liable for any direct, indirect, incidental, consequential, special, or punitive damages arising from your use of the Site or your implementation of any Assessment Output. In no event shall our liability exceed the amount paid by you for the specific service giving rise to the claim.
25. Defense and Indemnification
You agree to indemnify, defend, and hold harmless Productus Solutions LLC, DBA Homegevity, its founders, officers, employees, agents, contractors, subcontractors, and affiliates from and against all claims, liabilities, damages, losses, and expenses including reasonable attorneys fees arising from your use of the platform, your implementation of any Assessment Output, your interactions with your clients, or your breach of these Terms and Conditions.
26. Entire Agreement
These Terms and Conditions together with our Privacy Policy and Disclaimer constitute the entire agreement between you and Productus Solutions LLC, DBA Homegevity with respect to the Site and its services. They supersede all prior communications and proposals whether electronic, oral, or written.
27. Modifications to Terms
We reserve the right to update or modify these Terms and Conditions at any time. Changes will be effective immediately upon posting to the Site, with the Updated date reflecting the most recent version. Your continued use of the Site following any changes constitutes your acceptance of the revised Terms. We encourage you to review this page periodically.
28. Severability
If any provision of these Terms and Conditions is found to be invalid or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, and all remaining provisions shall continue in full force and effect.
